ICBC to appeal Cdn$12.5-million jury award

The Insurance Corporation of British Columbia (ICBC) is appealing a B.C. Supreme Court decision to award a woman Cdn$12.5 million in damages, an ICBC representative has told Canadian Underwriter.After a five-day trial, a jury awarded the insured Cdn$6.5 million in personal damages, $5.6 million for loss of future earnings and $335,000 for future care, the Times Colonist reported.Between 2006 and 2008, Marcheline Ciolli was rear-ended twice and struck on the driver’s side by another vehicle exiting a parking lot. She claimed to suffer injuries to the spine, neck, shoulder and back as well as nausea and headaches.An ICBC representative told the Times that none of these accidents were major and that none of her injuries were catastrophic. As a result, the ICBC believes the award is “excessive to the extreme.”
